Our clients won a major victory on Tuesday that will help preserve access to credit for Colorado consumers who need it most, after a federal judge preliminarily enjoined a Colorado statute that would have imposed interest-rate and fee caps on loans made to Colorado residents by state-chartered banks located outside Colorado.The National Association of Industrial Bankers, the American Financial Services Association, and the American Fintech Council sued in March, asserting the Colorado statute is plainly invalid because it is inconsistent with federal law.Granting plaintiffs’ motion for a preliminary injunction, U.S. District Judge Daniel D. Domenico found that the trade groups “have made a strong showing that they are substantially likely to succeed on the merits of their preemption claim.”Congrats to the DWT team led by David Gossett along with his colleagues Chava Brandriss, Chris Swift, Christopher Walczyszyn, Matt Ladew, and Tyler Bourke--as well as Matthew Schwartz, Morgan Ratner, and Leslie Arffa from and Ed Perlmutter and Leah E. Just weeks before the U.S. Supreme Court decided Sheetz v. In celebration of Juneteenth, our offices across the country hosted luncheons catered by local Black-owned businesses, while we listened to a history of Juneteenth by Associate Professor Brandon Byrd in a firmwide educational session. At DWT, we are committed to fostering an environment where everyone feels valued, respected, and empowered to thrive. Juneteenth allows us to pause and reflect as we think about our history and its impacts and honor the contributions of Black Americans to our law firm and broader society.
